These terms govern your use of the website at kloudmorph.io (the “Site”), operated by Kloudmorph, LLC (“Kloudmorph,” “we,” “us”). By accessing or using the Site, you agree to these terms. If you do not agree, please do not use the Site.
The Site is informational
The Site describes Kloudmorph’s cloud-architecture practice and publishes our writing. Nothing on it is an offer, a warranty of results, or professional, legal, or security advice for your specific situation. Any consulting engagement is governed by a separate written agreement signed by both parties; if anything in that agreement conflicts with these terms, the signed agreement controls for that engagement.
Acceptable use
You agree not to:
- use the Site unlawfully, or in a way that infringes anyone’s rights;
- attempt to gain unauthorized access to the Site or its infrastructure, or probe, scan, or test its security without our written permission (see our security contact below for coordinated disclosure);
- interfere with the Site’s normal operation, including through automated overload, scraping that degrades service, or circumvention of security controls;
- misrepresent your affiliation with Kloudmorph or use our name or marks in a misleading way.
Intellectual property
The Site and its content — text, essays, design, layout, graphics, and the Kloudmorph name and mark — are owned by Kloudmorph or used with permission, and are protected by intellectual-property laws. You may read, quote briefly with attribution, and link to our published writing. You may not copy substantial portions, republish, or present our content as your own without our written permission. Product and software licensing (for example, for Kloudmorph’s products) is governed by the separate license that accompanies each product, not by these terms.
Third-party links
The Site may link to third-party sites we do not control. We are not responsible for their content, practices, or policies. Following an external link is at your own risk.
Disclaimers
The Site is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that its content is complete or current. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Kloudmorph and its members will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of the Site. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars (USD 100). Nothing in these terms limits liability that cannot be limited under applicable law. This section does not govern liability under a signed engagement agreement, which contains its own liability terms.
Indemnification
You agree to indemnify and hold Kloudmorph harmless from claims and expenses arising out of your misuse of the Site or your breach of these terms.
Privacy
Your use of the Site is also subject to our privacy policy and cookie policy, which are incorporated into these terms by reference.
Changes
We may update these terms from time to time. We will change the date above, and material changes will be made prominent. Continuing to use the Site after an update means you accept the revised terms. We may also modify or discontinue the Site, in whole or in part, at any time.
Governing law
These terms are governed by the laws of the State of Delaware, where Kloudmorph, LLC is organized, together with applicable United States federal law, without regard to conflict-of-laws principles. The exclusive venue for any dispute relating to the Site is the state and federal courts located in Delaware, and you consent to their jurisdiction. Nothing here waives any right you have under the mandatory law of your own place of residence.
